Tutoring Contract: Template and Key Clauses (2026)
A tutoring contract is the agreement between a tutor and a student, or more often the student's parent, for private academic lessons. It sets out the subject and level, when lessons happen, how cancellations and payment work, and, because many students are children, how safeguarding and parental consent are handled. A clear contract protects the tutor's time and income and gives the family a written understanding of what is promised. Below is a template you can copy, followed by a walk-through. This is general information, not legal advice. Rules on contracts with minors, safeguarding checks, consumer rights and data protection vary by country and state, so confirm the local position. ## A tutoring contract template you can copy ``` TUTORING AGREEMENT Date: [date] Tutor: [name, qualification, contact] Client: [parent or adult student name, contact] Student: [name and age if a minor] 1. Frequently asked questions
- Who should sign a tutoring contract when the student is a child?
- The parent or guardian should sign and is the contracting client, because in most places a contract with a minor cannot be enforced against the child. The parent gives consent to the tuition and is responsible for payment. The contract should name the student but make clear that the adult is the party bound by the terms.
- Does a private tutor need a background check?
- It depends on where you work and who you teach. Many places expect a criminal record or background check for anyone working with children, such as an enhanced DBS check in the United Kingdom. State in the contract whether you hold one and can provide it. Even where it is not legally required, offering it reassures families and is good practice.
- Can a tutor guarantee a grade or exam result?
- No. The result depends on the student's own work, the exam and other factors a tutor does not control. Promise to support the student with reasonable skill and include a clause stating that a particular grade or result is not guaranteed. Guaranteeing a grade is both unfair and difficult to defend if the student does not achieve it.
- Should online tutoring lessons be recorded?
- Only with clear consent. If you record lessons, get the parent's written consent where the student is a minor, say what the recording will be used for, and store it securely. Recording can protect both tutor and student, but it involves a child's personal data, so handle it under the data protection rules that apply where you work.
